Types of Divorce in Malaysia
In Malaysia, divorce can be initiated through several legal avenues under the Law Reform (Marriage and Divorce) Act 1976:
Mutual Consent (Joint Petition for Divorce)
Both spouses agree to the divorce and its terms (child custody maintenance and asset division) making the process smoother and faster (approximately 2 to months from the signing of the cause papers).
Contested Divorce (Unilateral Petition)
Filed by one spouse due to reasons such as adultery, unreasonable behavior or desertion.
Judicial Separation
A legal alternative to divorce where spouses remain legally married but live separately. This allows parties to formalize separation without dissolving the marriage with terms that specify child custody, maintenance, and asset division.
Annulment
A marriage that is less than two (2) years can be declared void or voidable under specific legal grounds.
